We are pleased to provide you with this training opportunity. We hope that you benefit greatly from this experience and that you apply the concepts and techniques with success and safety in the future.
This manual and the application of the techniques and theories described are extensions of the seminar experience. Attendance at this training is not intended to be used as a hands-on license. You must work within your scope of practice and abide by the laws that govern healthcare practices in your applicable region. It is essential that the purity of this work and the high-quality teaching standards established for this curriculum be maintained and honored. Unfortunately, there are some spa directors who pay for individuals to take our training and expect them to come back and train the whole staff for free. This approach is not only unethical it’s not safe!
As such, if you wish to present or teach any portion of the copyrighted material from the workshop, you must first undergo the required training and obtain written permission from Health & Bodyworks.

This agreement is made between Health & Bodyworks LLC (Company) and is effective as of the date of the last signature below. All information and materials to be provided to you, both oral and written, or otherwise shared with you in the seminar, are confidential and proprietary property of the Company. Dissemination of Company's proprietary information provided to you during the Ashi Thai© Workshop is conditioned upon your acceptance and agreement to be bound by this agreement and specifically to be bound by the following restrictions and obligations:
1. You agree that to conduct any derivative course, program or protocol re-created or adapted from the Company information given to you constitutes a material breach of this agreement.
2. You agree that you will not teach, instruct, demonstrate, hold seminars or otherwise use or disclose any the Company's information that you have received during any of the seminars taught by the Company without the express prior written permission of the Company.
3. You agree that you will honor the obligations and restrictions set forth above. You understand that any violation of the restrictions set forth above constitutes a material breach of this agreement for which you will be liable to pay damages to the Company. You agree that, in the event that a legal action is commenced for breach of this agreement, you will be responsible for all Company attorney fees incurred.
Company agrees, in consideration of receipt of a seminar fee and your agreement to be bound by the above obligations and restrictions, to disclose to you the protocols, sequences, techniques and materials in the seminar for which you have paid your seminar fee. This agreement shall be governed by the laws of the state of Colorado applicable to contracts as if wholly made in any such state. In any dispute arising out of this contract you agree to be subject to personal jurisdiction and venue in Colorado.
The Barefoot Massage techniques described as Ashi-Thai or Ashiatsu Oriental Bar Therapy in both the live hands on workshops or Home Study DVD are not intended to replace the service of a professionally trained or certified healthcare provider. The sequences and protocols are not a medical treatment, diagnoses or replacement for the care of a medical doctor. The materials presented are NOT a medical treatment, a procedure, a manipulation, a rehabilitative therapy or a cure for any diagnosis. The information is simply a massage/stretching program that should only be distributed by a massage therapist or person(s) with equivalent knowledge in anatomy.
Instructional information is offered with the understanding that the suggestions, techniques or ideas should be performed safely and correctly by the participant. Health & Bodyworks LLC, its instructors and Ruthie Piper Hardee accepts no liability of injury that may arise from the use or misuse of the material presented.
By signing this liability waiver in the space provided below, you hereby acknowledge and agree that the compression stretching program called Ashi-Thai is a deep tissue massage and stretching technique and that, as a result of the application of the technique administered by persons who are learning the material for the first time, you may experience some pain, stiffness, soreness, skin irritations, marks, headaches, sinus congestion, bruises or other injuries or conditions (“Residual Effects”). IN CONSIDERATION FOR RECEIVING THIS INFORMATION, YOU HEREBY AND FOREVER WAIVE, RELEASE AND AGREE TO HOLD HEALTH & BODYWORKS UNLIMITED, LLC (THE “COMPANY”) AND ITS EMPLOYEES, CERTIFIED INSTRUCTORS, OFFICERS AND SHAREHOLDERS HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, CAUSES OF ACTION, COSTS AND EXPENSES THAT YOU MAY SUFFER IN ANY WAY RELATING TO THE TECHNIQUE OR ITS RESIDUAL EFFECTS INCLUDING, WITHOUT LIMITATION, ANY CLAIM FOR CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, REGARDLESS OF THEIR CAUSE (INCLUDING CLAIMS OF NEGLIGENCE OR OTHERWISE). This Waiver and Release shall be governed by and construed in accordance with the laws of the State of Colorado without regard to its conflicts of law’s provisions. To the extent that any portion of this Waiver and Release is determined by a court of competent jurisdiction to be invalid or otherwise unenforceable, the remainder hereof shall be construed so as to effectuate the intent of the parties hereto to the greatest extent possible.
